Member's agreement with the University of Auckland Recreation Centre

  1. I must produce the appropriate membership card to gain entry to the facilities. If I fail to produce my membership card I will only be granted entry to the facilities by producing a valid form of photo identification (i.e. drivers’ licence or passport) so that my membership status can be verified. I understand that I can only access the facility 3 times without my membership card, in which instance I will have to purchase a replacement card or return with my membership card. In the event I lose my card, a replacement fee of $6.00 will apply.
  2. I acknowledge that I am responsible for the security of my membership card and that no other person is entitled to use it. In the event that another person attempts to use my card to access the Recreation Centre, I understand that my card will be seized and returned to me as the rightful bearer. I accept that if the card or my barcode from this card had been used with my knowledge I am liable for its misuse and this will result in termination of my membership. I acknowledge that my ability to re-join thereafter is at the discretion of Recreation Centre management.
  3. In using the Centre I undertake to abide by the rules relating to the use of the facilities (which at all times includes the equipment provided) and any reasonable requirements of the Centre as directed by staff. This includes the use of towels whilst exercising, wearing suitable clothing and footwear at all times and leaving personal belongings in the spaces provided. 
  4. I understand that unless for the purpose of attending an official University of Auckland event, the Centre will not admit all persons under 15 years of age without express permission from Recreation Centre management. In either instance, the child must be under constant supervision by a parent or guardian and the appropriate entry fee paid (casual rates apply). Under no circumstances are persons under the age of 15 permitted in the Health and Fitness Studio or the Group Fitness Studio without having a caregiver first sign a waiver when entering the facility.
  5. I acknowledge use of the facilities involves risk of injury and/or damage and subject to any rights I may have pursuant to the Consumer Guarantees Act 1993, I agree that  by using these facilities I personally assume that risk and release The University of Auckland and its officers and employees from any liability, claims, losses, damages or expenses caused by or arising out of or in connection with my use of the facilities, including but not limited to:
    - personal injury or death
    - loss or damage arising from accidents or negligent acts
    - property loss or damage any other loss, damage, suffering, emotional or nervous shock or disorder.
  6. In signing this form I confirm that I suffer from no physical or medical condition which may be aggravated by my use of the facilities. 
  7. I understand that, pursuant to the Occupational Health & Safety Act, if my use of the Recreation Centre is deemed to present a risk to myself or others, my access may be restricted or revoked.
  8. I acknowledge that whilst training in the Centre(s) I must respect the rights and privacy of others. Any form of harassment, whether physical or verbal, towards another person or group, including Recreation Centre staff members, will result in suspension or termination of my membership. 
  9. I understand that I am not permitted to assist or train any other individual or group within the Recreation Centre. I acknowledge that if I am training with more than one other person I must desist if requested to do so by a Recreation Centre staff member.  
  10. I understand that if I am using an area within the Recreation Centre for an activity other than its designated purpose, I must desist if requested to do so by a Recreation Centre staff member.  
  11. I understand that the hours of operation of the Recreation Centre may change from time to time, subject to seven days notification. In the event of an emergency, I acknowledge that an enforced closure may take place without prior notification. 
  12. I understand that the location of the Recreation Centre or the level of service offering may change without notice and my membership will remain active until expiry for access to the new facility or services. 
  13. I consent to receive medical treatment in the case of injury, accident, or illness which I may suffer in the course of or connected with my use of the facilities of the Centre and agree to indemnify The University of Auckland and its officers and employees against any claims in respect of such treatment.
  14. I agree that subject to any rights I may have pursuant to the Consumer Guarantees Act 1993 I will not bring any action, proceeding, or litigation against The University of Auckland or any officers or employees for the risks or perils referred to in 4 above, seeking compensatory or any other form of damages in any Court in New Zealand or in any other country.
  15. I agree that my successors, executors, administrators and next of kin are bound by the provisions of this release form.
  16. No cycles or e-scooters are allowed within the building.
  17. UOA Recreation Centre memberships are non-refundable and non-transferable.
  18. Suspensions of 2-20 weeks are available for Direct Debit memberships only. The member must provide 2 week’s notice and complete a suspension request form. Suspensions are not available for paid in full memberships.
  19. Any person who is a member of the University staff or is currently enrolled as a student shall be subject to the provisions of the University Disciplinary Regulations if they fail to comply with the rules of the Centre(s).
  20. Any person who is not a member of the University staff or is not currently enrolled as a student at the University and fails to comply with the rules of the Centre(s) must leave the Centre(s) if requested to do so by a staff member and the circumstances shall be reported in writing to the Registrar who shall have the power after making such inquiries as he or she considers appropriate, to impose one or more of the following penalties:
    - such a sum as may be appropriate for any damage caused;
    - a fine not exceeding $500.00;
    - a limit or probation on that person’s use or enjoyment of the Centre(s) or other facilities of the University
